Abstract
The 401 water quality certification process, which provides for state review of the water quality aspects of a hydropower licensing proposal, is open to abuse by state personnel philosophically opposed to renewable resources. This paper outlines one state's response to the 401 process, originally promulgated to insure that potential impacts to water quality are acknowledged and mitigated.
