Common Land: Administration and Long-Term Managment of Open Space in Cluster Developments

Citations
Abstract
This Community Guide offers practical guidance for cities and towns on the effective administration and long-term management of open space in cluster subdivisions. It assists communities in evaluating ownership options for common open space by outlining their respective advantages and disadvantages, and provides strategies for ensuring effective maintenance and stewardship. Addressing frequently asked questions, the Guide helps alleviate concerns related to the adoption of cluster bylaws and the subdivision or special permit review process. An implementation section includes sample bylaw language, recommended open space design standards, and best practices tailored to Massachusetts law. While focused on open space intended for conservation, agriculture, and passive recreation, the Guide acknowledges that more intensively used recreational areas may require specialized management. Ultimately, this resource aims to support local governments, developers, and planners in making informed decisions, encouraging broader and more successful application of cluster development throughout Massachusetts.
